Other things that matter to us: - Translation when needed. - The chat tool’s features. Say someone gets a long phone call mid-chat: they pass the chat to a colleague, and support carries on. - Seeing which pages the customer has visited. - Conversation history. If the same customer comes back 6 months later, earlier conversations are there to see. - Answering from one place, without handling Facebook and Instagram separately. #### A smooth start, and why email still matters We were a little nervous at first. Anything new can seem scary, but everything went smoothly and we soon got over our fears. Once we started, there were no glitches or problems. With the technology set up and working, we can focus on answering customers in chat as fast as possible. That makes us more likely to help them complete their bookings. Now that customers can chat, do phone and email still have an edge? The team’s answer: Chat is convenient. But we use email for much more than customer service, so for now we still need several tools. Whichever way customers want to reach Hookusbookus, we want to offer the options that suit them best. You invoice us, and we pay by bank transfer in euros within 30 days. - The first valid claim wins. One reward per paid account. - No ads on the Askly brand name, no spam, no self-referrals. ## 1. The reward Askly pays you **€500 for each client domain that becomes a paid Askly account** through you. There is no limit on the number of clients. The reward is paid once per paid account. It is a fixed amount: it does not depend on the plan or on how long the client stays after it qualifies. A different company's paid account earns a new reward. Amounts exclude VAT. If you are VAT-registered, add VAT to your invoice as your local rules require. ## 2. How a client is credited to you - **Referral link.** The client signs up for Askly through your personal link, which carries your partner code. - **Partner code.** The client, or you, gives us your partner code within 14 days of the client signing up. - **Domain registration.** You register the client's website domain with [our form](https://www.meetaskly.com/partners/#join). Register before the client signs up, or within 14 days after, if nobody else has claimed the domain and the client confirms. A registration stays valid for **6 months**. If the client's project is still under way, ask once for another 6 months. We confirm or reject each registration **within 5 working days**, with the reason. We may email the client once to confirm that you work together. **The first valid claim wins**: the earlier link sign-up, code or registration. In a dispute, the client's written answer decides. We never share one partner's claims with another. ## 3. What a domain is We use the main domain, in lower case, without "https://", "www." or a path: clientshop.com. For a shop on a platform address, the full address counts: clientshop.myshopify.com. One paid account earns one reward, even if it covers several domains or country versions. ## 4. When a domain counts as paid A domain qualifies when the client's Askly account for it is on a paid plan, **has paid its first subscription invoice, and is still on a paid plan 60 days later**. The 60 days cover refunds and cancellations. Free plans, free trials, setup fees and unpaid invoices don't qualify. **Example:** your client signs up on 3 March and pays its first invoice on 17 March. It is still on a paid plan on 16 May, so it appears on your 1 June statement. You invoice us €500 on 2 June, and we pay by 2 July. ## 5. How and when we pay On the first working day of each month, we email you a statement of the domains that qualified in the month before. You send Askly OÜ an invoice, and **we pay by bank transfer within 30 days** of receiving it, in euros. We pay companies and registered sole traders who can issue an invoice. If you are a private individual, ask us first. There is no minimum payout. Once paid, a reward stays yours: we don't claw it back, except in cases of fraud. You are responsible for your own taxes. ## 6. What doesn't count - Domains that already had an Askly account, a paid plan or an active trial before your claim. - Clients who had a demo or a sales conversation with Askly in the 60 days before your claim. - Your own company's domains, companies in your group, and sign-ups made on a client's behalf without the client's agreement. - Referrals from spam, fake sign-ups, misleading claims about Askly or its prices, paid search ads on the Askly brand name, or coupon and cashback sites. We may withhold rewards for these. ## 7. Using the Askly name Describe Askly accurately and link to askly.me. Don't present yourself as Askly, and don't promise prices or results that Askly hasn't published. In public content, say that you earn a reward for recommending Askly. Tell clients that you are an Askly partner. ## 8. Changes and ending Askly may change or end the program with **30 days' notice** by email. Claims you made before a change keep the old rules. If the program ends, valid claims can still qualify. There are no inactivity rules: rewards you have earned stay payable. You can leave the program at any time by emailing us. To provide, improve and protect the service, we process: - **As controller:** the IP address, browser type, device name, email address and location of anyone who visits the service or sends us messages ("visitors"). - **As controller:** the personal data of our clients: the name, domain and email address they give us ("you"). - **As controller:** information about how you use the service and the actions you take in your account, for example the features you use and the settings you change. Through it, we collect and process call logs (the start, end and duration of each call), the caller's phone number and the call transcript. The audio is not kept after transcription. At the client's request, recordings and transcripts are sent directly to the client's own server, in which case Askly does not store them. Calls are processed within the European Economic Area (EEA) (see "Sub-processors and data location"). AI responses are generated with the OpenAI service under Standard Contractual Clauses (SCCs) and a Data Processing Agreement (DPA). ## How we protect personal data We respect everyone's right to the protection of their personal data, and we do our utmost to keep the personal data we receive and collect secure and confidential. We apply internal policies and physical, technical and organizational measures to protect personal data against unlawful or unauthorized destruction, loss, alteration, disclosure, acquisition or access. These measures include HTTPS encryption for all data in transit, role-based access control (RBAC), two-factor authentication (2FA) and logging of all access. When we process personal data based on consent, we ask for it in a clear, distinguishable and understandable way, and we record it in our logs and databases. You can withdraw your consent at any time. The law may require us to disclose personal data to authorities or supervisory bodies, or to give them access to it. ## How long we keep personal data We keep personal data only for as long as the law or a contract requires, or as long as our business operations need it. Personal data collected through the chat widget and the voice agent is kept for a minimum of 12 months and is then deleted automatically. Each client may agree with us on a different period, after which we permanently delete the personal data. ## Sub-processors and data location We use trusted sub-processors that are bound by equivalent data protection obligations, and we have signed a Data Processing Agreement (DPA) with each of them. Written conversations and attachments are processed within the EEA and do not leave it. Some voice agent processing (AI response generation) takes place in the USA under Standard Contractual Clauses (SCCs). Our sub-processors: - **DigitalOcean:** server and data hosting (Frankfurt, Germany, EEA). ISO 27001, SOC 2 Type II, PCI DSS. - **Google Vertex AI / Gemini:** AI response generation (europe-west4, the Netherlands, EEA). Data does not leave the EEA and is not used to train models. - **Google Cloud Translation API:** translation of conversations when needed (EEA). ISO 27001, SOC 2, GDPR compliant. - **Railway:** voice agent servers and infrastructure (Europe, EEA). SOC 2 Type II, GDPR DPA. - **Soniox:** speech to text (Europe, EEA). SOC 2 Type II, ISO/IEC 27001, GDPR, HIPAA. Audio is not used to train models. - **OpenAI:** response generation for the voice agent (USA, under SCCs and a DPA). We notify clients of any change to our sub-processors at least 30 days in advance. ## Our website - meetaskly.com is hosted by Cloudflare, which processes technical data, such as your IP address and the pages you request, to deliver the website and protect it from attacks. - We count visits without cookies: which page is open and for how long, which site or campaign sent the visitor, the country and the type of device, and clicks on buttons such as "Try free". No IP address, identifier or anything in your browser is stored. The counts are kept in Cloudflare's European data region for up to 400 days. - We use Google Analytics on meetaskly.com only if you accept analytics cookies. All sensitive payment information you provide is encrypted and handled by Stripe Technologies. All payments are processed by Stripe and are neither stored nor processed on our servers. ## Legal bases for processing We process your personal data: - to perform a contract with you, or to take steps at your request before entering into one (GDPR Article 6(1)(b)); - with your consent (Article 6(1)(a)), for example for analytics cookies on our website; or - on the basis of Askly OÜ's legitimate interest (Article 6(1)(f)), which includes asking for your consent to further processing and answering messages sent through our contact forms. ## Who we share your data with We do not sell or share information that identifies our clients with companies, organizations or individuals outside Askly OÜ, except in these cases: - **With your consent.** We share information with companies, organizations or individuals outside Askly OÜ when you have agreed to it. - **Analytics and business partners (limited, non-identifying information).** We may share aggregated or pseudonymized information, including demographic information, with partners such as analytics providers and applications, for example social media integrations with our service. - **Sub-processors.** We share data with the sub-processors listed under "Sub-processors and data location", only as far as needed to provide the service, always under a Data Processing Agreement (DPA) and, where required, Standard Contractual Clauses (SCCs). If you use third-party applications or websites integrated with our service, they may collect information about your activity under their own terms and privacy policies. We apply a range of security measures when you place an order or enter, submit or access your information, to keep your personal data secure. Apart from the providers named in this Privacy Policy, your personal data is not transferred outside Askly OÜ. For the service, transfers outside the EEA take place only for the voice agent's AI response generation (OpenAI, USA), under Standard Contractual Clauses (SCCs) and a Data Processing Agreement (DPA). For our website, see "Our website". ## Technical data we collect To improve our solutions, we collect this technical data about requests to our service: - IP address - date and time of the request - time zone difference from Greenwich Mean Time (GMT) - content of the request - access status and HTTP status code - amount of data transferred - the website the request comes from - browser - operating system - browser language and version We use this information to design our website to better meet our clients' needs. ## Marketing emails (CAN-SPAM Act) The US CAN-SPAM Act sets the rules for commercial email, gives recipients the right to stop receiving it, and sets strict penalties for violations. The web page is the original. # Terms of service ## Introduction Thank you for using Askly. We help companies provide online customer support in many languages and make their content multilingual. These Terms of Service ("Terms") govern your access to and use of our services, software and websites (the "Services"). Wherever you are located, your agreement is with Askly OÜ (registry code 14507205, Tartu mnt 82, 10112 Tallinn, Estonia). By using the Services, you agree to be bound by these Terms and our [Privacy Policy](https://www.meetaskly.com/privacy-policy/). If you use the Services on behalf of an organization, you agree to these Terms on behalf of that organization. ## Permissions When you use the Services, you upload or add files, content, messages and contacts ("Your Items"). Your Items remain yours. These Terms give us no rights to Your Items except the limited rights we need to provide the Services. We need your permission to host your Items, back them up and share them when you ask us to. The Services also offer features such as sharing, commenting, sorting, editing and searching. These and other features may require our systems to access, store and scan your Items. You give us permission to do so, and this permission extends to our affiliates and the trusted third parties we work with. We use Google's Cloud Machine Learning API and Translation API to provide certain features of the Services, and we are contractually required to make you aware of certain terms related to them. By signing up for an account and using the Services, you acknowledge and agree that you are also bound by the Google Terms of Service, including the Google Privacy Policy. The Services let you share your Items with others and work with third parties you choose, so please think carefully about what you share and with whom. We are not responsible for the conduct of any third parties, partners or linked websites. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the software, solely to access the Services. ## Your responsibilities You are responsible for keeping your account username and password confidential, and you must notify us immediately of any unauthorized access to or use of your account. Do not copy, upload, download or share content unless you have the right to do so. Parts of the Services may be protected by intellectual property rights. We may review your conduct and content for compliance with these Terms, but we have no obligation to do so. We are not responsible for the content that people post and share through the Services. You are also responsible for deciding whether the Services are suitable for you, given your obligations under any applicable regulations, such as HIPAA, GLBA, EU data protection laws (including the General Data Protection Regulation) (together, "EU Data Protection Laws"), United States export control laws and regulations and economic sanctions laws and regulations ("U.S. Export Control Laws and Regulations"), or other applicable laws. You may use the Services only as permitted by applicable law, including export control laws and regulations. To use the Services, you must be at least 13 years old, or older where local law requires it. If you live in Ireland, Germany or the Netherlands, you must be at least 16. Please check your local laws on the age of digital consent. If you do not meet these age requirements, you may not use the Services. These Terms remain in effect for as long as you have an account, or until you or we terminate the agreement under these Terms, whichever happens first. ## Beta features We sometimes release products and features that we are still testing and evaluating. They are marked as beta, preview, early access or evaluation (or with words of similar meaning) and may be less reliable than Askly's other services. ## Intellectual property and copyright The Services are protected by copyright, trademark and other EU and foreign laws. These Terms do not grant you any right, title or interest in the Services, in other people's content in the Services, or in Askly's trademarks, logos and other brand features. We welcome feedback, but we may use your comments or suggestions without any obligation to you. We respect the intellectual property of others and ask you to do the same. You may not distribute, exchange, modify, sell or transmit anything you copy from the Services, including any text, images, audio and video, for any business, commercial or public purpose. We reserve the right to delete or disable content alleged to be infringing and to terminate the accounts of repeat infringers. ## Paid accounts and services You can extend your use of Askly by adding paid features, which converts your account into a paid account and subscribes you to additional services. A paid account gives you additional capabilities and features. ## AI features By using Askly's AI features (such as the AI Support Agent, AI Search and AI Voice Agent, previously called the AI Assistant), you agree that machine learning technologies are applied to your conversations. We use third-party technology to provide the best possible service. By using the AI features, you: - agree that your conversation data is analyzed and processed with machine learning models; - understand that these technologies are used to improve customer service and to give more accurate and relevant answers; - accept that the third parties providing these technologies access your data only to the extent needed to provide the service. We aim to ensure that all data processing complies with applicable data protection laws and our Privacy Policy. The security and confidentiality of your data are of the utmost importance to us, and we take all necessary measures to protect it. ## Prices Before we process an order, you choose a paid plan and accept these Terms. Our prices are published on our website ([pricing](https://www.meetaskly.com/pricing/)). We may change our fees, and we will notify you in advance by email to the address associated with your account. Prices are in euros and exclude VAT, which is added where applicable. They include payment processing fees. ## Payment methods All transactions are in euros (EUR). You can pay by Mastercard, Maestro or Visa. Payments are processed by Stripe. ## Refunds If the Services are not delivered, we will do our best to improve our service to your satisfaction. We may offer a refund if the Services cannot be used because of issues caused by Askly. We are not responsible for third-party services, such as browsers, connectivity or security providers. ## Identification When a business relationship is established, we and/or the payment institution are required to identify the user. The identification method may vary with the requirements of the country where the user enters into the business relationship with us (for example, online or face-to-face identification). The user must provide any data and documents we request for identification. If we doubt the accuracy of the user's data or documents, we may ask the user to clarify their data, to provide additional information or documents to prove their identity, or, if necessary, to repeat the identification. By accepting these Terms, the customer gives us an irrevocable right to share identification and authentication information about the user with the payment institution, in any format. For security and legal reasons, we do not store or process users' bank or credit card details. We may change or add payment institutions in cooperation with the payment solutions we provide. ## Organization accounts If you sign up with an email address provided by your organization and use the Services for your organization's work, your organization may be able to block your access to Askly. You must use Askly in line with your organization's terms and policies. Such accounts are controlled by your organization: its administrators may access, disclose, restrict or remove information in or from your Askly account, and may restrict or end your access to Askly. Organization accounts have owners and administrators, who must act in line with the roles and permissions in Askly (under your account settings). ## Termination You may stop using the Services at any time. We may suspend or terminate your access to the Services, with notice to you, if: - you breach these Terms; - you use the Services in a way that creates a real risk of harm or loss to us or to other users; or - you do not have a paid account and have not used the Services for 6 consecutive months. ## Discontinuation of the Services We may discontinue the Services in response to unforeseen circumstances beyond Askly's control, or to comply with a legal requirement. If we do, we will give you reasonable notice so that you can export Your Items from our systems. If we discontinue the Services in this way before the end of a fixed or minimum term you have paid for, we will refund the prepaid fees for the period in which you did not receive the Services. ## Resolving disputes We want to resolve your concerns without formal legal proceedings. Before filing a claim against Askly, you agree to first try to resolve the dispute informally by contacting us at [info@askly.me](mailto:info@askly.me). We will try to resolve it informally by email. If the dispute is not resolved within 30 days of your contact, you or Askly may start formal proceedings. You and Askly agree that any court proceedings to resolve claims relating to these Terms or the Services will be brought in the courts of Estonia, and both parties consent to the venue and personal jurisdiction of those courts. If you live in a country (for example, the United States) whose laws give consumers the right to bring disputes in their local courts, this paragraph does not affect that right. You and Askly agree that any dispute arising from the relationship between the parties under this agreement will be settled by an arbitrator chosen under the Arbitration and Internal Rules of the European Court of Arbitration (part of the European Centre of Arbitration, seated in Strasbourg) in force when the request for arbitration is filed. Adopting this clause constitutes acceptance of those rules. The seat of arbitration is the Arbitration Court of the Estonian Chamber of Commerce and Industry. The proceedings will be held in English, and Estonian substantive law applies.
